I put over 50,000 miles on my 3 with no issues whatsoever. If it was a parts issue, I would think the car would have failed early in it's service life (1-6 months in service.), not after 42,000 miles.

OK, met with DCSM yesterday. We are still head butting. Howvere now they are changing there story.

Since the oil test from Blackstone confirms antifreeze in the engine, now they state I must have overheated the engine and that is why my oil got low and the bearing scrotched.

So here is my question, can I have them oull a report from the ECU to show a overheating event, or any other event while we are at it?

That would be my suggestion. I know (have heard/read) the ECU tracksmax RPM's so I don't see why it wouldn't log all other out of tolorence events?

I don't particularly like Big Brother looking over my shoulder, but in this case it might work to your advantage... if it can be done.

I know the Computer on my Bobcat records overheat events so I would think Our cars would also.
Now if it is a internal leak without an overheat episodeyou have a case.

Thanks guys for all the responds.

Mazda has now taken the engine apart. I have taken pictures just like they have. I have shown my pics to another service mgr at a differrent Mazda dealership, who knows engines, as well as a guy who owns a repair shop that reviews lemon law cases for the state of GA.

They both agree, there is no heat damage, and they both have pretty much ruled out damage due to low oil. They believe a bearing went bad for who knows what reason and that caused the engine damage. The pictures also show a ton of oil on thebottom of the engine, even on the crankshaft. These were taken two days after the oil pan was removed. Stil dripping oil.

Last time I heard, Mazda was still denying the warranty work, however I did find out that on Friday the District Mgr sent a part to CA for review. INTERESTING!!!

So still waiting.

To thread jack a bit here, I took my car to the dealer today for perhaps the last time under warranty with a terrible running/starting/stalling problem. It's been acting up from time to time since I installed the CAI (Mazdaspeed by AEM.) I know of no one else that has had these problems w/the AEM or the MS intake, but occasional CELs, "nosing over" during spirited accelerating and REALLY bad running have all been part ofmy problemsover the last year. That said, and after trying a number of things on my own, I finally made an appointment.

I got a call from them about an hour ago. They replaced the MAF sensor, the 3rd engine mount (TSB #03-001/06,) reflashed the ECU (Mazda calls it the PCM) w/the latest upgraded software,repaired the window "snap" (TSB #09-015/05,) and gave me a 2008 6i (ATX. BLAHHHH!!!) to drive in the mean time and are charging me... nothing!!!
I was ready for a fight."Well, your aftermarket exhaust caused..... You installed the CAI yourself, so your warranty is.... Aftermarket wheels always cause vibration." You get the idea.
I was so surprised.

Was this the same dealer that didn't believe that the TSB I printed out & held in my hand 3 years ago was false?? The same people that treated me like a typical "woman" customer in spite of the fact that I indicated I knew something about cars and had been in the business myself for 10 yrs???
Tomorrow morning I pick her up. That's when I'll be completely convinced that this is, or is not the same dealer......
