Hatch release button only works when ignition is on????

I have a problem with my 2008 DE hatch release button which i suspect is not right.
Firstly, is the hatch release (button under rear badge) supposed to work when your ignition is off? because mine does not .. no power to the button at all, if i unlock the car with the remote, all four doors can be unlocked no issue however pressing the hatch button does nothing, it's unpowered. The only way it works is if ignition is on (the click after accessories) and then the hatch button and mechanism all works perfectly when pressed .. everything i have read said it is supposed to be active all the time unless the car is in drive.. but, like said, mine only works if ignition is on (and not in gear)
If mine is faulty, what on earth can it be ?? i've replaced the button, made no difference .. i don't think its anything on the mechanism or the like as it all works fine, it just seems like it's a signal issue and i'm worried it's BCM related..
Also, curiously, pressing unlock button on the remote fob will release the locks on all four doors .. i would also assume it's meant to be two front doors on first press, and rear rears on second, i wonder if that has anything to do with this weird electrical gremlin..
