Default 00 protege ES trans issue

Hi guy new to the forum. I have a 00 Protégé ES with 1.8 automatic. The other day I was driving and went to pass a vehicle on the highway. I kicked the car into passing gear and pass the car fine no problems. after about a mile my trans started to act funny. It would act like it was slipping in and out of gear. Now the car shifts fine through first and second gear but once it gets to third and overdrive it seams like it kicks in and out of gear. My fluid is dark and I am going to change the filter and fluid tomorrow after work. the O/D light is not flashing or anything. Just wondering if anyone else has had this issue. I am also wondering if it could be internal or something else. Any feed back would be greatly helpful. thank you. O and its really noticeable once I hit 40 mph. when it does slip out of gear it feels like it slams into gear.

to be quite honest, that fluid should have been changed at least twice by now.
When my tranny went, it slammed hard in to a downshift after a momentary lapse.
The dealer changed it under warranty, but that was within first 3 years.

yeah I know the fluid should of been changed a LONG time ago. I just bought the car off another owner. I am just wondering if I am wasting my time on changing the filter and fluid or if it could be a solenoid issue?

Change the fluid & filter. Leave the pan off as long as you can to allow as much oil to drain out. Make sure the engine & trans are both fully warmed up 1st.
