They wouldn't. They would need to prove the air filter caused the damage. Ask most any attorney and add the Mag act into the equation.

We are well aware of many independent testing and they have been worn out for posting comments on forums. Not all is as you think. And this is where you need to do the research who sponsors some of those "independent companies.
As for your oil results... hmmm OK if you say so and want to blame it on your air filter. I trust what you say . Blackstone Oil testing Labs might have different information regarding the cause of your results? Maybe?
As for the dust in the intake I would have looked at the rubber sealing between the top and bottom of the OEM air box as a possible cause next time? .I have had the same thing happen and then readied that problem by simply a new OEM top.
I have come to the conclusion that people will generally make their own minds up regards of what some one posts.
