Transmission filter kit

Question Transmission filter kit

Today I took my car to the dealer to have the coolant flush service done, while performing this service the tech found a broken upper engine mount and a wet tranny pan. I was told by the service tech that my pan was leaking because a rubber gasket was used to seal my tranny pan instead of silicon. I called the company(a transmission shop) that serviced my transmission last(2000 miles ago) and they said that all the filter kits for Mazda 3 come with rubber gaskets so thats what they used, they agreed to service the tranny again but for warranty purposes they want to use the supplied rubber gasket in the kit instead of silicon. Mazda said that if my transmission fails and needs to be replaced under warranty and they find it was serviced with an aftermarket transmission kit i.e rubber gasket they could deny my claim. So I'm stuck do I pay Mazda $211.00 for a tranny service or do I take to the company I already paid and have them fix it for free? I'm thinking I might take it to the transmission shop and have it fixed for free and keep an eye on the fluid level. I spent $350.00 today at Mazda to have the engine mount fixed and coolant flush done so I don't want to spend anymore money. Has anyone used an after market tranny service kit with a rubber gasket have leaking problems?

I don't think that's quite right, Vince.
If what the other shop did to your car caused a problem then Mazda would not be responsible. But if the trans fails for an internal reason other than being run low on fluid (your responsibility,) they would have to cover it as a defect in manufacturing. Seems to me they are using scare tactics to get you into their Service Dept.
If your car is still under warranty why the hefty bill? Did they charge you for the motor mount?

Yes, the car is still under warranty. I have a $100 deductable. The motor mount was $130.00, the coolant flush $149.99, taxes.

Update, Transmission wasn't leaking. I had the shop put the car on the lift and we couldn't find any fluid, pan was dry an clean.

Well, that's certainly good news, Vince. Better that than a fight over the warranty, or perish the thought, a bad transmission.
