DPF removal now an MOT failure - but garages still selling it - what's going on?

Default DPF removal now an MOT failure - but garages still selling it - what's going on?

Since February driving with a DPF removed is illegal according to this:

I've got DPF problems with my Mazda 5 at the moment, and have called a few garages who say it's not an MOT failure because they leave the catalytic converter in place, and that they are still removing DPFs regularly.

What's the opinion here?
