Hi Guys I hope this is in the right place, I bought a 2013 cx 5 with 60k 2.2.

8 days later it developed a fault. The diagnosis was second turbo boost flap is broken & not functioning.

The dealer offered to repair but I worry he's a cowboy. He refused my right to reject before 30days and said it wasn't present at time of purchase, and if I insist on refund he'll send me his lawyers details.

Would you say the car was unsatisfactory condition at point of sale

Dealers can have all sorts of ins and outs here in the states but must follow state rules on sales if there are any.
I have no idea about your side of the Atlantic.
Meaning I wouldn't say anything without seeing the actual sales contract you signed including all it's fine print.

My 2014 just hit 55,000 miles. My 2013 MX5 has 23,000. My 2014 Jeep Grand Cherokee Overland has 52,000. We just don't drive as much since retiring (me in 2007 and my wife in 2015).

 

The member is from Glasgow, meaning his 60K is kilometers which is about 37,300 miles which is over 16,000 less you have on your 2014 which you admittedly don't drive much.
I find it extremely unlikely a 2013 CX-5 would have that few miles on it.
It's not a seasonal use sports car, but a year-round SUV.
The 2013 Mazda CX-5 (Turbo diesel 2.2) is not likely a vehicle that someone would purchase and not drive much.
There sticker cost in 2013 started at just under $30,000 (US dollars) in the UK.
All that said, there are also a few exceptions, but they are extremely rare.
The 2.2 turbo diesel engine can be prone to issues especially if not well maintained and looked after.

When my mother died in 2007, I gave her 1989 Mercury Grand Marquis to my brother-in-law. That car had made a number of trips from her home in Arizona to us in Ohio and elsewhere in the country and then came back to Ohio when she moved up here in 2001. I was questioned in depth when we transferred the title because the car only had 89,000 miles on it.

When you're retired and can travel, you can put a lot of miles on a car at one time, but if you live in a community with nearby stores and churches, you don't put the daily miles on it like you might otherwise. We don't know the status of the prior owner and caution would be warranted with an older, low mileage vehicle, but it isn't out of the question

The maintenance issues are another factor which doesn't really fit into the discussion.

 

If you just look at averages the US is 13,000 miles and the UK is 7400 miles or just under 12,000 kilometers.
Schmieg admits he drives very little but in 11-10 years still put on 130,000 total miles which is actually the US average (except he did it with 3 vehicles).
Doogie Talons says his vehicle had 60K or 37,282 miles which is significantly less than the UK average per year.
It is my personal opinion that Mr. Talon's vehicle mileage is suspect to me. His personal assessment of the dealer (cowboy), albeit one-sided, would further enhance me to come to this mileage hypothesis.
So those of other opinions may respond away at no difference to me or my opinion. After all they can chose to be wrong if they so wish
Either way I'm not a fan of diesels except for hauling loads and the 2013 Mazda 2.2 turbo diesel is known for the following issues, especially if not properly well maintained.
Blown head gaskets/cracked cylinder heads from sudden overheating with no warning.
Oil dilution / resulting in raised oil levels.
Oil pump inlet blockage from soot.
Camshaft wear from oil problems.
Timing chain wear from oil problems.
Diesel Particulate Filter (DPF) clogging.
EGR system clogging with carbon.

 

LOL yes ... we can all agree that at one time or another I am sure we owned a car or own a car that is over 5,10 years - or older with low miles.
My MINI 2002 that I bought new in 2002 only has28k miles on the odometer.
