Recall 4507C - Anti lock Brakes
 
I brought my 2001 Mazda Tribute into the dealer for the ABS Safety recall on 9/2/2008. The discription of recall isthaton certain sport utility vehicles equipped with antilock brakes (abs), the abs module connector may have missing or dislodged wire seals. this condition could allow contamination to enter the module connector, creating a potential for an electrical short. The dealer stated they performed the necessary inspection and work.

Then 2 1/2 months later my ABS unit overheated and caught on fire.

The consequense they list for this recall is exactly what happened to ABS unit - An electrical short might cause an abs malfunction that would illuminate the abs warning light, and in some cases, the module may overheat resulting in burning odor, smoke, and/or fire. this condition could occur either when the vehicle ignition switch is in the off position or while the vehicle is being operated.

The dealer/Mazda is declining to repair my ABS brakes stated that they performed the necessary inspection and work.

I contend they did not perform the necessary work properly or otherwise why would my ABS unit fail as described in the recall.

The dealer states that the ABS unit could have failed due to a short caused by Battery Voltage not in spec (Mazda Full Circle Inspection Code B1676) which I declined to repair because they wanted to charge me 2 hours ($200) for a diagnostic only that was not covered by the safety recall.

Could Battery Voltage not in spec caused my ABS unit to malfunction and catch fire?

What recourse or action can I take against Mazda as they are refusing to repair?
