The EGR valves on these tend to get stuck as they age, get covered in hard carbon. If you pull a vacuum on the EGR while idling, it should sputter and maybe stall out. New EGRs are expensive, suggest taking it off, cleaning out the carbon, see if pulling a hand vacuum actuates the lever, and that the lever fully closes when vacuum is not applied.

I have cleaned out the egr and I noticed when I pulled it off the second time it had already built up some carbon in a very short time also when you say pull a vacuum line do you mean just disconnect the line or apply vacuum so the valve will open? Any idea about the black soot that comes out of the exhaust is this connected to the egr problem?

When vacuum is applied to the EGR, the valve should open. Without vacuum, the valve should close ALL the way. The black carbon must be carbon that has condensed because the EGR is a few degrees cooler than the engine passages.
