Default Are all the cx-9 transfer cases time bombs?!

Wife is looking for a new car after an 18 year old rear ended her beloved Veracruz. The cx-9 (2010-2012 ish) fits the replacement bill as Veracruzs are pretty rare. But, I try to do my research and I see all kinds of transfer cases in these failing before 75k miles due to a heat issue.

​​​​​​Are theae all going to fail?

Will it survive fine as long as a change fluid every 10k?!

And is there anyway to know (other than service records) if it's been replace?

If it's been replaced, is the issue "fixed" or just waiting to blow up again?
